Poland’s Office of Competition and Consumer Protection (OCCP) believes that the government should consult the European Commission to determine whether the proper procedure was followed during the tendering of a fourth mobile operator license.
The tender for a fourth mobile operator started in May. On 5 September Netia paid ZL345 million for the license. However, there are still questions about the way the tender was awarded and whether Netia was given favourable treatment. Jaroslaw Mackowiak of the OCCP believes certain interests were given priority in the tender.
In such a situation, the OCCP recommends that the Office of Telecommunications and Post Regulation (URTiP) should refer the case to the European Commission to ensure that all legal requirements have been met. If the URTiP do not consult the EC then Netia Mobile should do so themselves.
